The Code Enforcement Officer is an appointed position responsible for administering and enforcing all provisions of the New York State Uniform Fire Prevention and Building Code, the New York State Energy Conservation Construction Code and Burke Local Law #1 of 2006.
The Code Enforcement Officer issues Building Permits, Certificates of Occupancy, Temporary Certificates, Operating Permits and Burn Permits.
A Building Permit shall be required for any work which must conform to the Uniform Code and/or the Energy Code, including, but not limited to, the construction, enlargement, alteration, improvement, removal, relocation or demolition of any building or structure or any portion thereof, and the installation of a solid fuel burning heating appliance, chimney or flue in any dwelling unit. No Person shall commence any work for which a Building Permit is required without first having obtained a Building Permit from the Code Enforcement Officer (Code Officer).

No permit is required for detached sheds of 144 square feet used to store tools and provide storage or used as a play house. Playground equipment, swimming pools of less than 24 inches of water depth and entirely above ground are exempt as are retaining walls unless they support a surcharge or Compound Class I, II, or IIIA liquid. Painting, wall papering, tiling, carpeting or finish work does not need a permit
